MAJOR GROWTH AREA

Mauritius has become a key destination for South Africans, whether relocating for retirement or establishing global company and trust structures for new business ventures or managing existing international assets.

Post-Covid, the small island state has experienced exceptional growth, with property values rising by 20–40% as pent-up demand from global buyers quickly absorbed most available properties in areas popular among South Africans, including Black River, Tamarin, and Grand Baie.

Many South African buyers have purchased property in their personal names, which could lead to complications in the event of death and spousal inheritance.

Samina Jaffer stated, “A trust is a particularly effective legal vehicle, as opposed to holding property in one’s personal name, to house fixed assets such as a home. This is especially important because property inheritance laws in Mauritius are based on the Napoleonic Code, which prescribes how property passes on death.”

Venture capitalists establishing new companies are also encouraged to set up structures to hold these assets, typically with an operating company owned by the trust.

A LAYER OF PROTECTION WITH SIGNIFICANT ESTATE DUTY IMPLICATIONS

► Existing trusts can be transferred to Brent Consulta at no additional cost, often with more competitive pricing.

► Interest in Mauritius has also been boosted post-Covid by the work-from-anywhere trend and ongoing power supply challenges in South Africa.

► Under current tax laws, it is possible to earn up to R1.25 million per year without paying South African tax, based on the so-called 183-day rule. This allows taxpayers who spend at least 183 days outside South Africa each tax year to legally avoid South African income tax.
